Shattering the quiet

If you drive about 500 miles southwest of New York City, you will come to the town of Martinsville, Virginia. Though it has an outsized motto -- "a city without limits" -- it is a small town with a population of about 13,000 sitting amidst the rugged outdoors of the western half of the state.

Life is typically quiet there. Sometimes the quiet is broken by the sound of crunching metal, breaking glass and squealing tires, however.

Last month, two people were seriously injured when the vehicle they were in was struck by a cable TV truck driven by an allegedly intoxicated company employee. The cable truck driver, 54, was charged with driving while intoxicated, reckless driving and refusing to take a breath test.

The collision happened when the cable truck driver ran his vehicle off of the road and then swerved back across the center line and into the oncoming pick-up containing two people.

The driver of the pick-up suffered injuries so severe that he is listed as incapacitated. The man's father has filed a $20 million lawsuit, with the cable company and its driver listed as defendants.

The lawsuit claims the cable company was negligent in having the allegedly intoxicated driver as an employee and allowing him to drive, despite having "full knowledge and awareness that he not only had a problem with the consumption of alcoholic beverages...and a history of driving while consuming alcoholic beverages."

According to a news report, the driver was apparently convicted of DUI while in the employ of the cable company.

We don't know how this case will turn out, but we do know that attorneys experienced in personal injury litigation can answer questions about injuries suffered in motor vehicle accidents.
