Attractive nuisances can lead to injured children

Children are very inquisitive and enjoy exploring things. Those common childhood actions can lead to children being placed in harm's way. When a child is injured during explorations, there is a chance that the parents might seek compensation for the child's injuries based on the legal concept known as attractive nuisance.

We understand that "attractive nuisance" isn't something that most people are familiar with. This term refers to objects, features or items that are so attractive to children that a child wouldn't be able to resist coming over to explore it. Some examples of an attractive nuisance would be swimming pools, play sets and swing sets.

People who have attractive nuisances on their property have a special duty to try to protect children from being harmed by the nuisance. In the case of swimming pools, the owner has to ensure that all laws regarding safety are complied with. Having a locking fence around the pool is one of the ways a property owner could keep children out of the pool. We understand that trying to figure out if a person complied with proper safety protocol can be very difficult when you are trying to take care of a child who has been injured. We can investigate issue and help you learn about what really happened to cause the accident.

In New York, there are laws that require proper fencing and pool alarms in pools. If a child is injured because these safety features aren't present, the parents of the child might choose to seek compensation for the injuries. We can help the parents of injured children to determine how to approach a claim for compensation.
