What is the Hip Joint?

The hip is a major joint that takes the weight of your upper body stable, while also acting as a ball-and-socket joint for your legs.  There is a lot of force placed on your hips from not just your upper body, but also from the shock and pressure from walking.  That makes your hips one of, if not the most, important joint in your body.

New York Slip & Fall Accident Lawyer for Broken Hip InjuriesThe hip joint is made up of two main bones, the pelvis and the femur.  The pelvis is what most people consider to be your “hips,” and it is a large, wing-like bone that joins your upper body and lower body.  The femur is your leg bone and considered to be the strongest bone in your body.  It is also the longest single bone.

The part of the femur that connects to the pelvis is the femoral head.  It fits into part of the pelvis that is the acetabulum.  This is the ball (femoral head) and socket (acetabulum) of the hip joint.

What is a Hip Fracture?

Although the hip is very strong, it is suspectable to fracturing and breaking in a slip and fall.  According to statistics, there are more than 300,000 hip fractures each year in the United States.  There are generally two locations that the hip may fracture in a slip and fall.  The first is in the femoral neck, or the area where the femur (leg bone) connects with the hip at the socket.  This is a very painful injury and often results in a prolonged recovery.  Sometimes it will not fully heal and restrict the range of motion of a victim.

The second location is in the intertrochanteric region.  This area is further down on the femur and breaks before the femur’s head extends into the pelvis.  This injury is also very painful but, when properly repaired, it can have less of an impact on a person’s stability.  However, it can still be a very painful fracture and it can still result in significant lost wages, medical bills, and time away from work.  Some people who suffer this type of fracture will have permanent disability.

There are other types of hip fractures too.  Some of these fractures involve the pelvis itself.  A fracture in the pelvis, particularly in the acetabulum, can also create extreme pain.  Although a broken bone in the pelvis is less likely to cause disability now, the damage is causes can be permanent and result in future injuries.  This includes causing arthritis or degeneration of the bone.  Unfortunately, that means the hip joint may need to be partially or totally replaced—a major surgery.

Do I Need to Go To Trial or Can I Get a Slip and Fall Broken Hip Settlement in New York?

Even though you were subjected to the negligence of another person, business, or government entity, your hip fracture and fall case will likely never go to trial.  Approximately 95% of all civil cases settle before trial, meaning that you will never have to go to trial and may be able to get a slip and fall broken hip settlement.  Many of these cases even settle pre-commencement, meaning that you may not even need to sue the defendant or defendants who harmed you.

But most cases will require some litigation, often going through the disclosure (discovery) process.  This is where the parties will exchange information about their positions, including medical records, scene photographs, and other information.  Usually, this information and a party’s story will been examined at a deposition, which is where one attorney gets to ask the other party or witnesses questions about the case.  Sometimes there is also motion practice before a settlement too.

Ultimately, most victims will get a slip and fall broken hip settlement in New York.  These are very serious injuries that most defendants will not allow a jury to decide.  Rather, they will want to have some control in the resolution through negotiating and settling the case.  This is not to saw that all hip fracture cases settle – because some do not – but like most civil cases, broken bone cases settle.
