Other Department of Education employees, including paraprofessionals, school nurses and occupational and physical therapists must file for workers compensation benefits.

How Can a NYC Teacher
Receive Line of Duty Injury Benefits

When a New York City teacher or other “pedagogue” is injured while working, they must follow the strict rules and procedures outlined by the NYC Department of Education Personnel Memorandum No. 4, 2002-2003 entitled, “Policy and Procedures on Line of Duty Injuries for Pedagogical Employees.” These procedures include:

  • Notify the administration of any accident or injury within 24 hours and fill out one or both of the following:
    • Comprehensive Injury Report
    • UFT Incident Report (if victim of assault or recklessness)
  • Notify your UFT chapter leader of your injury
  • The Comprehensive Injury Report must be sent to the superintendent for approval by your school’s principal within 24 hours.

The superintendent must administratively approve or disapprove the Comprehensive Injury Report within five days of receiving the report. Once approved, a formal application must filed with the Self-Service Online Leave Application System. Additional forms are also required.

NYC Teachers Can Also
File A Personal Injury Claim

New York City teachers and other Department of Education “covered” employees may also file a claim for personal injuries in addition to receiving LODI benefits even if their injuries were caused by a coworker or the Department of Education.
